The Business Activities and Business Owner/Operator Identification forms have not been <br /> completed and submitted. This information must be current and submitted as part of the business plan. <br /> REGULATION GUIDANCE: A Hazardous Materials Business Plan (HMBP)shall be established and implemented <br /> for emergency response to a release or threatened release of a hazardous material when storing hazardous <br /> materials at or above the thresholds quantities of 55 gallons for materials that are liquids, 500 pounds for solids, or <br /> 200 cubic feet for compressed gas, at standard temperature and pressure. <br /> CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at <br /> http://cers.calepa.ca.gov/, enter the required information, and submit for review by the EHD./Submit a <br /> statement/documentations to SJC EHD demonstrating that the HMBP has been established and implemented. <br /> This is a Class II violation. <br /> 5 HSC 25505(a)(1) Failed to electronically submit hazardous materials inventory for all reportable materials on site. <br /> OBSERVATION: The following chemicals were found on site and have not been reported to CERS: <br /> Forty-six 275 gallons totes(approximately 12,00 gallons)of unknown content. EHD was unable to verify contents <br /> through labels and onsite personnel.
