OBSERVATION: Facility does not meet the Ag exemption and failed to complete and submit training program(s). REGULATION GUIDANCE: To meet this exemption, a farming business shall: -annually submit the Hazardous Materials Inventory -mark each building that stores any pesticides, petroleum fuels and oil, or fertilizers with warning signs -provide training for all employees in safety procedures in the event of a release or threatened release of a hazardous material. Training programs for all employees and annual training, including refresher courses, shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or threatened release of a hazardous material.Training shall cover, but not limited to, all of the following: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate notice,for the business site. These training programs may take into consideration the position of each employee. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, enter the required information, and submit for review by the EHD./Submit a statement/documentations to SJC EHD demonstrating that the HMBP has been established and implemented. This is a Class II violation. This is a Class II violation. Overall Inspection Comments: Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were nine violations observed during the inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by 02/5/2022. Notes: Observed several open totes and containers. Ensure all the containers are closed to prevent spill and exposure. Business has been in operation longer than thirty days. According to Xiaozhen Mai the chemical totes have been on site since October and November 2021. Documents provided: Inspection report, corrective action statement form, return to compliance form and a schedule of approve free CUPA training classes.
