OBSERVATION: An approved copy of the response plan was not available for inspection. REGULATION GUIDANCE: A copy of this plan shall be accessible on site at all times. This was corrected on site. This is a repeat violation, Class II. 208 CCR 2716(a -e) Failure to comply with the designated operator inspection requirements. OBSERVATION: The designated operator failed to check and note all required items on the visual inspection reports. The incorrect and missing information included the following from the inspection reports: -Section 9 "UST System Inspection" was missing the "Spill Containment ID" for the diesel tank REGULATION GUIDANCE: During the visual inspection, the designated operator shall check that all required testing and maintenance for the UST system have been completed and shall check all required items on the report. CORRECTIVE ACTION: Ensure that designated operators performing visual inspections at this facility are including all of the required information on the reports. This is a repeat violation, Class II. 210 CCR 2715(c) Failure to provide initial training, train every 12 months, and have a trained employee present. OBSERVATION: The designated operator employee training for Eduardo Quezada and David Rodriguez had not been performed at the time of inspection. REGULATION GUIDANCE: The designated operator shall train facility employees in the proper operation and maintenance of the UST system at least once every 12 months. The training shall be conducted before the individual performs the duties of a facility employees. The training shall include, but is not limited to: 1. Operation of the UST system in a manner consistent with the facility's best management practices 2. Employee's role with regard to monitoring equipment as specified in the facility's monitoring plan 3. Employee's role with regard to spills and overfills as specified in the facility's response plan 4. Name of the contact person(s) for emergencies and monitoring equipment alarms Initial training shall also include a site-specific practical demonstration that provides both sharing information and evaluating knowledge for responding to emergencies, leak detection, monitoring alarms, spills and overfills. At least one of the facility employees present during operating hours shall have current training. The employees were trained by the designated operator during the inspection. This was corrected on site. This is a Class II violation. Overall Inspection Comments: The inspection was started on May 23, 2022 and was completed on May 24, 2022. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by June 23, 2022.
