"Hazardous Material Management" <br /> poster. When asked how a waste determination is made for such items,Tina Flores,the assistant store manager, <br /> stated she either asked the store manager, Patricia Brewer, or she would guess which HW tote the item should be <br /> placed in.Tina did not appear familiar with the Sally Beauty Hot Line number listed on the"Hazardous Material <br /> Management poster to call if questions came up.Also,Tina did not know about the Sally Beauty Application,which <br /> provides item Safety Data Sheets(SDS)to make waste determinations, until she called her District Manager, Hillary <br /> Mcgahey.At this point,Tina still was not clear on information needed to help make a waste determination from the <br /> SDS. Towards the end of the inspection she told us there is a new poster to help identify waste streams that <br /> apparently was sent to the store, but they had not received. <br /> -Two containers of Gigi Hemp Wax, one of which was leaking and without absorbent,were found in the Corrosive <br /> Acids HW tote(IMG 2549-2550, 2554-2555).According to Sally Beauty Holding's"Guidelines for Accumulating <br /> Hazardous Waste" poster, absorbent must be placed in the bag with a leaking container(IMG 2557). <br /> -A container of GIGI Sensitive Tweezeless Wax was found in the Oxidizers HW Tote(IMG 2601-2604). <br /> -A leaking bottle of Protein Color Filler Primer Corrector Refresher was found without absorbent in the Corrosive <br /> Bases HW tote(IMG 2573-2575, 2559-2560). <br /> -A bottle of Blond Brilliance Perfect Blond Instant Tone Mask was found in the Corrosive Bases HW tote (IMG <br /> 2576-2578, 2559-2560). This item was found in a bag which also contained three used tubes of Loreal Chroma <br /> True Red's permanent hair color. <br /> -A container of Beyond The Zone Demented Styling Goo and a container of Barbury's By Sibel Pomade were <br /> found in the same bag inside the Aerosols, Flammables&Combustibles HW tote(IMG 2579-2581, 2191-2595). <br /> A generator shall make a hazardous waste determination and keep a record of any test results,waste analyses, or <br /> other determinations made in accordance with hazardous waste regulations for at least three years from the date <br /> that the waste was last disposed of. Immediately locate a copy of the hazardous waste determination made for any <br /> waste not already listed on the"Hazardous Materials Management" poster, ensure store employees are familiar with <br /> these waste determinations, and submit a copy to the EHD. If a copy is unavailable, immediately make a hazardous <br /> waste determination and begin managing the above listed waste under Title 22 hazardous waste regulations. <br /> This is a Class II violation. <br /> 104 CCR 66262.34(d)(2)No modified contingency plan. <br /> An emergency coordinator and modified contingency plan information is lacking. There must be at least one <br /> emergency coordinator on site or on call to coordinate emergency response measures, and the following <br /> information must be posted by a phone: the name and phone number of the emergency coordinator; location of fire <br /> extinguishers, spill control equipment, and if present,fire alarm; and the phone number of the fire department, <br /> unless the facility has a direct alarm. Immediately appoint an emergency coordinator and post the required <br /> information by a phone.
