The following is an itemized list of hazardous waste violations that have not been addressed for SALLY BEAUTY SUPPLY as of June 02, 2020. Open violations from December 14, 2018 inspection Violation#103-Failed to retain hazardous waste determination including waste analysis on site for 3 years. The hazardous waste(HW)items listed below were found in HW totes with labels that did not include these items, nor items of similar composition, as contents of the totes, nor were the items on the Sally Beauty Holdings Inc. "Hazardous Material Management"poster.When asked how a waste determination is made for such items, Francisco Valle,the store manager, stated he will ask his manager which tote the item should be placed in. Francisco was not familiar with the Sally Beauty Hot Line number listed on the"Hazardous Material Management poster to call if questions came up.Also, Francisco did not know about the Sally Beauty SDS Application (see photo IMG 3104),which provides product Safety Data Sheets(SDS)to assist in making waste determinations. -A bottle of Gigi Slow Grow with Argan Oil hair minimizer was found in Corrosive Acids HW tote(IMG 2969). -A bottle of Gigi Pre Hon pre-wax cleanser was found in the Corrosive Acids HW tote(IMG 2970). -A bottle of Gigi Post Wax Cooling Gel skin freshener was found in the Corrosive Acids Hw tote(IMG 2971). -A bottle of Gigi No Bump Solution skin smoothing topical solution was found in the Corrosive Acids HW tote (IMG 2974). - Four bottles of Toppik Hair Buidling fibers were found,two in the Corrosive Acids HW tote(IMG 2980-2983), and two in the Toxic&State Regulated HW tote(IMG 3027, 3029). -A bottle of BTZ Beyond The Zone Rock On Volumizing Powder was found in the Aerosols, Flammables, & Combustibles HW tote(IMG 2992-2993). -Two bottles of One'N Only Colorfix Part 2: Conditioning Catalyst were found in the Aerosols, Flammables, & Combustibles HW tote(IMG 2994-2995),while this item was also found in the Oxidizers HW tote(IMG 3053-3054). -Two bottles of One'N Only Colorfix Part 1: Color Reducer were found in the Aerosols, Flammables, & Combustibles HW tote(IMG 2996),while this item was also found in the Oxidizers HW tote(IMG 3053-3054). - Derma E Essentials Overnight Peel and Derma E Firming DMAE Serum with Alpha Lipoic and C-Ester were found in the Aerosols, Flammables, &Combustibles HW tote(IMG 2997-2999). -A bottle of Curly Kids Super Detangle Spray was found in the Aerosols, Flammables, &Combustibles HW tote (IMG 3003-3005). -Two containers of Beauty Secret Dip Kit Acrylic Powder Nail Color were found in the Aerosols, Flammables, & Combustibles HW tote(IMG 3006-3007). -A bottle of ProLinc Callus Eliminator was found in the Aerosols, Flammables, &Combustibles HW tote(IMG 3011-3013). -Two containers of Eco Style Professional Styling Gel Black Castor&Flaxseed Oil were found, one in the Aerosols, Flammables, &Combustibles HW tote, and the other in the Toxic&State Regulated HW tote (IMG 3021-3022, 3024-3025). -Two containers of Eco Style Professional Styling Gel Olive Oil was found in the Toxic&State Regulated HW tote (IMG 3021, 3023). -A container of Silk Elements Strength'N Silk Edge Gel with coconut oil&silk was found in the Toxic&State Regulated HW tote(IMG 3026-3028). -Surgi Wax was found in the Oxidizers HW tote,while containers of Gigi Creme Wax and Gigi Milk&Honee Wax were found in the Corrosive Acids HW tote(IMG 2965-2968, 2973, 3049-3052). The store manager identified all of the above listed items as waste at the time of inspection. -After reviewing the contents of the totes, the Sally Beauty Holdings, Inc. Hazardous Waste Training Guide was reviewed,which contained "Hazardous Materials: Examples,"which listed types of products under each of the six hazardous waste categories (IMG 3067-3068). These lists contained additional guidelines/examples for waste determination.The store manager did not appear to use the lists in the binder when making waste determinations, as he referred only to the labels on the HW totes at the time of inspection. A generator shall make a hazardous waste determination and keep a record of any test results,waste analyses, or other determinations made in accordance with hazardous waste regulations for at least three years from the date Page 2 of 3
