"Hazardous Material <br /> Management"poster(The Poster)posted on the door in the facility's HW storage area (IMG 3360): <br /> -A container of Gigi Dark Honee wax for hair removal was found in a State Toxic HW tote(IMG 3384, 3388-3389). <br /> -A container of Gigi All Purpose Hard Wax for hair removal was found in a State Toxic HW tote(IMG 3384, 3388, <br /> 3390). <br /> -A container of Gigi Creme Wax for hair removal was found in a State Toxic HW tote(IMG 3384, 3388, 3391). <br /> -Three containers of Toppik Hair Building Fibers was found in a State Toxic HW tote(IMG 3381, 3384, 3392). <br /> When asked how a waste determination is made for such items,the assistant store manager, Gianna Garcia, stated <br /> if an item is not indicated on The Poster or the HW tote labels, she asks the Store Manager, Sandra Nunez, to <br /> determine which bin an item should be placed in. Gianna stated she has never used the Sally Beauty Hot Line <br /> number listed on The Poster, nor has she used the Sally Beauty Safety Data Sheet(SDS)application on the store's <br /> Ipad, if questions came up regarding hazardous waste categorization. <br /> A generator shall make a hazardous waste determination and keep a record of any test results,waste analyses, or <br /> other determinations made in accordance with hazardous waste regulations for at least three years from the date <br /> that the waste was last disposed of. <br /> Immediately locate a copy of the hazardous waste determination made for any waste not already listed on the <br /> "Hazardous Materials Management" poster, ensure store employees are familiar with these waste determinations, <br /> and submit a copy to the EHD. If a copy is unavailable, immediately make a hazardous waste determination and <br /> begin managing the above listed waste under Title 22 hazardous waste regulations. <br /> This is a Class II violation. <br /> 104 CCR 66262.34(d)(2)No modified contingency plan. <br /> An emergency coordinator and modified contingency plan information is lacking. <br /> There must be at least one emergency coordinator on site or on call to coordinate emergency response measures, <br /> and the following information must be posted by a phone:the name and phone number of the emergency <br /> coordinator; location of fire extinguishers, spill control equipment, and if present,fire alarm; and the phone number <br /> of the fire department, unless the facility has a direct alarm. <br /> Immediately appoint an emergency coordinator and post the required information by a phone.
