The following is an itemized list of hazardous waste violations that have not been addressed for SALLY BEAUTY SUPPLY as of June 02, 2020. Open violations from December 28, 2018 inspection Violation#103-Failed to retain hazardous waste determination including waste analysis on site for 3 years. The hazardous waste(HW)items listed below were found in HW totes with labels that did not include these types of items as contents of the totes, nor were these types of items on the Sally Beauty Holdings Inc. "Hazardous Material Management"poster(The Poster)posted on the door in the facility's HW storage area (IMG 3360): -A container of Gigi Dark Honee wax for hair removal was found in a State Toxic HW tote(IMG 3384, 3388-3389). -A container of Gigi All Purpose Hard Wax for hair removal was found in a State Toxic HW tote(IMG 3384, 3388, 3390). -A container of Gigi Creme Wax for hair removal was found in a State Toxic HW tote(IMG 3384, 3388, 3391). -Three containers of Toppik Hair Building Fibers was found in a State Toxic HW tote(IMG 3381, 3384, 3392). When asked how a waste determination is made for such items,the assistant store manager, Gianna Garcia, stated if an item is not indicated on The Poster or the HW tote labels, she asks the Store Manager, Sandra Nunez, to determine which bin an item should be placed in. Gianna stated she has never used the Sally Beauty Hot Line number listed on The Poster, nor has she used the Sally Beauty Safety Data Sheet(SDS)application on the store's Ipad, if questions came up regarding hazardous waste categorization. A generator shall make a hazardous waste determination and keep a record of any test results,waste analyses, or other determinations made in accordance with hazardous waste regulations for at least three years from the date that the waste was last disposed of. Immediately locate a copy of the hazardous waste determination made for any waste not already listed on the "Hazardous Materials Management" poster, ensure store employees are familiar with these waste determinations, and submit a copy to the EHD.
