4. CONTINUANCE OF "BDIVISION MAP NO. S-84-7 c- THOMAS FORNASERO
(C/O DAVE OLMSTEAD) _or a 17 -lot subdivision 1 ated on the north
side of Fair Oaks Road, 820' east of MacArthur Drive, southeast
of Tracy. This item was continued from the hearing of July 19,
1984.
Planner Cindi Eliason introduced a staff report into the record.
She noted that Public Works' conditions used old ordinance numbers
and should be changed. Banta Carbona Irrigation District has
changed their condition to read, "The district's open irrigation
lateral adjacent to the subdivision is to be fenced at the deve-
loper's expense and is to be approved by both Banta Carbona
Irrigation District and Public Works."
PUBLIC HEARING OPENED
PROPONENTS
Dave Olmstead was present to represent the applicants. He agreed
to the amended conditions.
OPPONENTS
George Brenner, Community Development Director, City of Tracy,
was present to state his concerns. He did not understand the
finding of no adverse impact without proper data about the soil,
onsite sewage disposal, and possible onsite storm drainage. In
regard to Fair Oaks Road serving as a collector for the area, he
does not believe that the 50' right-of-way for Fair Oaks Road
with the level of coming development is adequate, and he is pro-
posing a minimum minor collector width be proposed. He is also
concerned about the lack of fire protection for the area and
other services.
REBUTTAL: No rebuttal was offered.
PUBLIC HEARING CLOSED
Al Blevins of Public Wurks said that his recommendation is based
on a 50' right-of-way.
r
