4. CONTINUANCE OF "BDIVISION MAP NO. S-84-7 c- THOMAS FORNASERO <br />(C/O DAVE OLMSTEAD) _or a 17 -lot subdivision 1 ated on the north <br />side of Fair Oaks Road, 820' east of MacArthur Drive, southeast <br />of Tracy. This item was continued from the hearing of July 19, <br />1984. <br />Planner Cindi Eliason introduced a staff report into the record. <br />She noted that Public Works' conditions used old ordinance numbers <br />and should be changed. Banta Carbona Irrigation District has <br />changed their condition to read, "The district's open irrigation <br />lateral adjacent to the subdivision is to be fenced at the deve- <br />loper's expense and is to be approved by both Banta Carbona <br />Irrigation District and Public Works." <br />PUBLIC HEARING OPENED <br />PROPONENTS <br />Dave Olmstead was present to represent the applicants. He agreed <br />to the amended conditions. <br />OPPONENTS <br />George Brenner, Community Development Director, City of Tracy, <br />was present to state his concerns. He did not understand the <br />finding of no adverse impact without proper data about the soil, <br />onsite sewage disposal, and possible onsite storm drainage. In <br />regard to Fair Oaks Road serving as a collector for the area, he <br />does not believe that the 50' right-of-way for Fair Oaks Road <br />with the level of coming development is adequate, and he is pro- <br />posing a minimum minor collector width be proposed. He is also <br />concerned about the lack of fire protection for the area and <br />other services. <br />REBUTTAL: No rebuttal was offered. <br />PUBLIC HEARING CLOSED <br />Al Blevins of Public Wurks said that his recommendation is based <br />on a 50' right-of-way. <br />r <br />
