A NJ O A Q U l N Environmental Health Department <br /> COUNTY— <br /> Underground Storage Tank Program Inspection Report <br /> Facility Name: Facility Address: Date: <br /> BILLJAR VALERO 153 E ELEVENTH ST,TRACY January 26, 2022 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 210 CCR 2715(c)Failure to provide initial training,train every 12 months, and have a trained employee present. <br /> OBSERVATION: The designated operator employee training for Danielle Kiraly was not performed.A Facility <br /> Employee Training Certificate listing Danielle's name was not observed on site. Per Danielle, she has been an <br /> employee since April 2021. <br /> REGULATION GUIDANCE: The designated operator shall train facility employees in the proper operation and <br /> maintenance of the UST system at least once every 12 months. The training shall be conducted before the <br /> individual performs the duties of a facility employees.The training shall include, but is not limited to: <br /> 1. Operation of the UST system in a manner consistent with the facility's best management practices <br /> 2. Employee's role with regard to monitoring equipment as specified in the facility's monitoring plan <br /> 3. Employee's role with regard to spills and overfills as specified in the facility's response plan <br /> 4. Name of the contact person(s)for emergencies and monitoring equipment alarms <br /> Initial training shall also include a site-specific practical demonstration that provides both sharing information and <br /> evaluating knowledge for responding to emergencies, leak detection, monitoring alarms, spills and overfills. At least <br /> one of the facility employees present during operating hours shall have current training. <br /> CORRECTIVE ACTION: Ensure that employees have been trained by the designated operator, maintain the list on <br /> site, and submit a copy of the training records to the EHD. <br /> This is a Class II violation. <br /> 319 CCR 2635, 2637.2,2665, 2712 Failure to comply with overfill prevention equipment requirements. <br /> OBSERVATION: 36 month overfill prevention testing has not been conducted. Overfill testing was last conducted on <br /> 1/23/2019 and was due by October 2021. The overfill testing was required to be conducted by 10/13/2018 and this <br /> facility was conducted late on 1/23/2019.The next due overfill is 36 month from the 2018 overfill date. Since this <br /> facility conducted their overfill late(2019), the next due date is not 36 month from the late 2019 testing, but 36 <br /> months from when the testing was required by(October 2018). <br /> REGULATION GUIDANCE: Overfill prevention equipment inspections were required to be conducted by October <br /> 13, 2018, and every 36 months thereafter, and within 30 days of completion of a repair. <br /> CORRECTIVE ACTION: Immediately schedule this testing and provide 48 hours notification to the EHD. Ensure all <br /> future testing is conducted within required time frames. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by 2/25/2022. <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br /> ($152).
