For purposes of this Final Judgment, the People and KMART shall be <br />referred to collectively as "Parties" and individually as "Party." The Parties have stipulated and <br />consented to the entry of this Final Judgment prior to the taking of any proof, and without trial or <br />adjudication of any fact or law herein.
