10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, Plaintiff, the People of the State of California ("People") and defendant Target <br />Corporation ("Target"), by their respective attorneys, entered into a Stipulation for Entry of Final <br />Judgment and Permanent Injunction dated January 27, 2011 and thereby have consented to the <br />entry of this Final Judgment and Permanent Injunction on Consent ("Final Judgment on <br />Consent"); <br />AND WHEREAS, the Court finds that the settlement between the People and Target is fair <br />and in the public interest; <br />NOW THEREFORE, upon the consent of the aforementioned parties, it is hereby <br />ORDERED, ADJUDGED, AND DECREED: <br />FINAL JUDGMENT AND PERMANENT INJUNCTION ON CONSENT <br />1. <br />The parties stipulate and agree that the Superior Court of California, County of Alameda <br />has subject matter jurisdiction over the matters alleged in this action and personal jurisdiction <br />over the parties to this Final Judgment on Consent. <br />2. SETTLEMENT OF DISPUTED CLAIMS <br />This Final Judgment on Consent is not an admission by Target regarding any issue of law <br />or fact in the above -captioned matter or any violation of law. The People and Target enter into <br />this Final Judgment on Consent pursuant to a compromise and settlement of disputed claims for <br />purposes of furthering the public interest. The People believe that the resolution embodied in this <br />Final Judgment is fair and reasonable and fulfills the People's enforcement objectives; that except <br />as provided in this Final Judgment on Consent, no further action is warranted concerning the <br />allegations contained in the First Amended Complaint ("FAC"), attached hereto as Exhibit A; <br />and that entry of this Final Judgment on Consent is in the best interest of the public. Target <br />agrees that this Final Judgment on Consent is a fair and reasonable resolution of the matters <br />alleged in the First Amended Complaint.
