Landfill, Metal Finishing Solutions at 1325 El Pinal Dr. in <br />Stockton, CA disposed of twenty-one 55-gallon plastic drums and sixty-two 5-gallon containers labeled as hazardous <br />materials at the landfill. The containers were found overturned and off-gassing in the north-west area of the landfill. Per Fire, <br />two of the 55-gallon drums released an unknown amount of what is believed to be sodium hydroxide (UN3266) and a <br />corrosive liquid containing nitric acid (UN1760), based on the drum labeling, onto the soil of the landfill. In addition to the <br />drums labeled UN3266 and UN1760, Fire also reported a drum labeled as UN2031 (Nitric Acid). Fire found the liquid on <br />one drum lid had a pH of 14. Fire uprighted the drums and containers, except for one drum that was buried beneath <br />garbage. Per Fire, most of the drums and containers appear to be empty, however several drums and containers may still <br />contain hazardous material inside.Metal Finishing Solutions has hired All Clean Hazardous Waste Removal, Inc. to conduct <br />the spill clean-up. <br />Please be advised that the disposal of any waste [HSC 5411] or disposal of any hazardous waste, or the causing thereof, is <br />prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 <br />(a)]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting <br />procedure [HSC 25160 (b)(3)]. <br />Notify the EHD prior to the clean-up being completed, in order for the EHD to verify. Provide all hazardous waste <br />determinations, sample analytical results, and waste/hazardous waste disposal records to the EHD for all clean up debris <br />associated with this clean up. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />° Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />° Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />IMMEDIATELY <br /> <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
