The <br />cause of damage is unknown. The diesel spilled onto the asphalt and covered and area of approximately 75 feet and <br />entered the facility's storm drain. <br />Clean up all spilled material and dispose of it under all appropriate waste manifesting and waste disposal laws and <br />regulations. Please be aware the disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is <br />at a facility which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Notify EHD (48-hours) in <br />advance of any cleanup activities. Provide disposal records for all generated wastes. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />" Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />u Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the END. <br />o Other Correction <br /> <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 08/17/17 Page 1 of 2 <br />1868 E.
