SAN JOAQUIN <br /> Environmental Health Department <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: ROSS ISLAND SAND AND GRAVEL Date: Nov 03, 2020 <br />RP Mailing Address: 4315 SE MCLOUGHLIN BLVD <br /> Record ID#: COGKTPVV7A <br />PORTLAND, OR 97202- Program Element: 2546 <br />Spill Location: 2201 W WASHINGTON ST, STOCKTON <br /> Release/Spill Response (excluding Joint Team) <br /> <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />AN UNKNOWN AMOUNT OF DIESEL WAS RELEASED INTO THE PORT OF STOCKTON. <br />OBSERVATIONS: <br />On 10-24-20 EHD received a CAL OES CONTROL#: 20-5938 spill report for a potential release from a sunken dredge <br />tender and barge adjacent to building 20 of the Port of Stockton. EHD was notified on 11-02-2020 that an unknown amount <br />of diesel was releasing from the sunken barge on Wednesday, 10-28-2020. <br />Investigate and abate contamination. Stop the leak. Clean up all released material and dispose of it under all appropriate <br />waste manifesting and waste disposal laws and regulations. The disposal of any hazardous waste, or the causing thereof, is <br />prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 <br />(a).] Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting <br />procedure [HSC 25160 (b)(3)]. Make a hazardous waste determination for all waste materials and dispose of them as <br />required, and provide proof of correction and copies of waste disposal records to the EHD. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Li Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Other Correction <br />EHD 25-01 Rev. 9/16/2020 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br />Page 1 of 2 <br />1868 E.
