Per Mike Poole (Ripon Public Works Engineering Division), the drain leads to a pond located at the Mistlin Sports
Park. I met with Mike and inspected the area and did not observe any sheen or odor in the pond area. We then inspected a
manhole located at the corner of Santos Avenue and Hoff drive and did not observe any sheen or odor. We went to the site
location (Chevron) and looked inside the storm drain west of the fueling dispensers and did not observe any sheen or odors.
I spoke to Chevron manager Karina Gordillo regarding the spill. Per Karina, the spill took place at dispenser 7. I inspected
the area around dispenser 7 and the impacted storm drain and did not observe any sheen or odor. Per Lean Mendoza of
Clean Harbors, they subcontracted Patriot Environmental for clean-up. Patriot Environmental responded yesterday for the
clean-up but stated that the rain had washed all traces of the gasoline spill. Patriot removed the absorbent booms from the
storm drain and placed them into hazardous waste drums, no other action was taken. Per Gerardo Acuna of Chevron, the
absorbent booms were placed into a 30 gallon hazardous waste drum and will be disposed of at a later time. The release
has been stopped, but not contained. Determine the extent of the impacted area(s), facilitate spill cleanup by properly
trained individuals, provide hazardous waste determinations and waste/hazardous waste disposal records for impacted
material to the EHD.
Please be advised that the disposal of any waste [HSC 5411] or disposal of any hazardous waste, or the causing thereof, is
prohibited when the disposal is at a facility that is not permitted or authorized for hazardous waste disposal. [HSC
25189.5(a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting
procedure [HSC 25160 (b)(3)].
VIOLATIONS:
Discharge of any waste, including sewage
(CA Health and Safety Code 5411)
Discharge of waste or sewage to water or within 150 ft. of waterway
(SJC Ordinance Code Sections 9-1125.3, 9-1125.4)
Improper disposal of a hazardous waste
(CA Health and Safety Code 25/89.5)
Permitting or Maintaining a Nuisance
(SJC Ordinance Code Section 8-5100)
Other Violation

ORRECTIVE ACTIONS / ORDER:
Investigate and abate contamination under the oversite of the appropriate lead agency.
IMMEDIATELY.

EHD 25-01 Rev. 9/16/2020 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE
Page 1 of 2
1868 E.
