SAN JOAQUIN <br /> Environmental Health Department <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: GM EXPRESS INC <br /> Date: Jul 01,2020 <br />RP Mailing Address: 19953 VALLEY BLVD STE A <br /> Record ID#: COPAGGF7Q <br />WALNUT, CA 91789- Program Element: 2546 <br />Spill Location: 0 SI-5 AT DOWNING AVE, Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />Approximately 30 gallons of diesel and 13 gallons of oil was released onto asphalt and soil due to a traffic collision. <br />OBSERVATIONS: <br />Dark oily staining was observed on the asphalt adjacent to the center divider. Diesel was observed to have traveled through <br />the center divider scupper onto soil. All Environmental Services was onsite and performed cleanup of asphalt. A USA dig <br />notification was initiated by All Environmental for removal of contaminated soil. Site was coned off and is pending <br />excavation. Please be aware that all impacted soil has to be excavated and disposed of under the appropriate waste <br />manifesting procedure [HSC 25160 (b)(3)]. The disposal of any hazardous waste, or the causing thereof, is prohibited when <br />the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Notify EHD <br />(48-hours) in advance of any cleanup activities. Provide disposal records for all generated wastes. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Other Correction <br />EHD 25-01 Rev. 08/17/17 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br />Page 1 of 2 <br />1868 E.
