SAN JOAQUIN <br /> Environmental Health Department <br />— COUNTY— <br />\ 4,,,,,,tx‘!/ Greatness grows here. <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br /> <br />Responsible Party: DR3 MATTRESS RECYCLING <br /> Date: Jun 17, 2021 <br /> <br />RP Mailing Address: 160W SANTA CLARA ST #900 Record ID#: COUMZRPXT <br />STOCKTON, CA <br />Program Element: 2546 <br />Spill Location: 4447 S AIRPORT WAY, Release/Spill Response (excluding Joint Team) <br /> <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />FACILITY FIRE IMPACTED 12 FIVE-GALLON PROPANE TANKS, THREE BALERS EACH CONTAINING <br />APPROXIMATELY 25 GALLONS HYDRAULIC FLUID, ONE OUT-OF-SERVICE FORKLIFT, AND ONE VEHICLE. <br />OBSERVATIONS: <br />On 6/13/2021, EHD received notification of a fire at DR3 Mattress Recycling. On 6/14/2021, a site visit was attempted, but <br />the facility was inaccessible. Bethany Cartledge, Economic Development Director for the facility provided a list of impacted <br />materials: twelve 5-gallon propane tanks, three balers each containing approximately 25 gallons, the rear of an <br />out-of-service forklift, and a Honda vehicle. <br />Clean up all released material and dispose of it under all appropriate waste manifesting and waste disposal laws and <br />regulations. The disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is at a facility <br />which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Please be aware that all hazardous <br />waste shall be disposed of under appropriate hazardous waste manifesting procedure [HSC 25160 (b)(3)]. Make a <br />hazardous waste determination for all waste materials and dispose of them as required, and provide proof of correction and <br />copies of waste disposal records to the EHD. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />° Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9 -1125.3, 9 -1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />c" Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />- Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />7 Other Correction <br /> <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1012 <br />1868 E.
