INDEIWITY AGREEMENT <br />INDEMNITY AGREEMENT made this <br />day of <br />SEP 91987 <br />ENVIROMENTAL HEALTH <br />FERMIT/SERVICES, <br />, 1987 by and between DON A. LOSE and DARLENE COSE, <br />hereinafter called "Indemnitor", and COUNTY OF SAN JOAQUIN and SAN <br />JOAQUIN LOCAL HEALTH DISTRICT, hereinafter called "Indemnitee". <br />R E C I T A L S: <br />A. Indemnitor is dividing real property within the community <br />of Tracy, California, into four residential parcels identified as <br />WAKEFIELD COURT. <br />B. In order to p-r-ov-ide for the construction and occupancy of <br />a single family residential dwelling on Parcel "D" of WAKEFIELD <br />COURT, Indemnitor, in providing water to that dwelling, is to have <br />that residential dwelling utilize water provided by wells within <br />San Joaquin County proposed community water service area number <br />35. <br />C. The wells within San Joaquin County proposed community <br />water service area number 35, while operational, have not yet been <br />accepted by either San Joaquin County or San Joaquin Local Health <br />District and hence do not currently qualify as CSA -35 public water <br />system. <br />D. Each of said wells continues to require modifications in <br />order to meet the water standards established by Title 22 of the <br />California Administrative Code. <br />
