E. Indemnitee has consented to the construction and <br />occupancy of a single family residential dwelling on Parcel "D" of <br />WAKEFIELD COURT. <br />F. In consideration thereof, Indemnitor agrees to indemnify <br />Indemnitee and each of them, to maintain in force and effect <br />insurance policies as required by San Joaquin Local Health <br />District which include San Joaquin Local Health District as <br />additional named insured, and, in addition, to preclude any <br />further construction of residential dwellings within WAKEFIELD <br />COURT until the two wells within the San Joaquin County proposed <br />community water service area number 35 have been accepted by both <br />San Joaquin County and San Joaquin Local Health District. <br />G. Indemnitee agrees to allow for the construction and <br />occupancy of a single family residential dwelling on Parcel "D" of <br />WAKEFIELD COURT, provided that it is indemnified from any claims <br />or damages arising from the use and/or consumption of water to be <br />provided to that dwelling by San Joaquin County proposed community <br />water service area number 35 as described herein. <br />NOW THEREFORE, the parties agree as follows: <br />1. Except for one existing dwelling on Parcel "A" of <br />WAKEFIELD COURT and one residential dwelling to be constructed on <br />Parcel "D" of WAKEFIELD COURT which are to connect to San Joaquin <br />County proposed community water service area number 35, no other <br />residential dwelling shall be constructed by Indemnitor in <br />WAKEFIELD COURT until the wells within San Joaquin County proposed <br />community water service area number 35 have been accepted by San <br />Joaquin County and San Joaquin Local Health District. <br />-2- <br />
