ODVENANT <br />Covenant made this 1st day of October, 1987 by and between <br />DON A. COSE and DARLENE COSE, hereinafter called "Grantor", SAN <br />JOAQUIN LOCAL HEALTH DISTRICT, hereinafter called "Coventee" and <br />JAMES STEPHEN PACE and SANDRA DENISE PACE, hereinafter called <br />"Grantee". <br />R E C I T A L S: <br />A. Grantor is dividing real property within the community of <br />Tracy, California, into four residential parcels identified as <br />WAKEFIELD CDURT. <br />B. In order to provide for the construction and occupancy of <br />a single family residential dwelling on.property more particularly <br />described in the attached Deed and commonly known as Parcel "D" of <br />WAKEFIELD COURT, as shown on parcel map MS 86-70 to be recorded <br />prior to the attached Deed, Grantor, in providing water to that <br />dwelling, is to have that residential dwelling utilize water <br />provided by wells within San Joaquin County proposed community <br />water service area number 35. <br />C. The wells within San Joaquin County proposed community <br />water service area number 35, while operational, have not yet been <br />accepted by either San Joaquin County or San Joaquin Local Health <br />District and hence do not currently qualify as CSA -35 public water <br />system. <br />D. Each of said wells continues to require modifications in <br />order to meet the water standards established by Title 22 of the <br />California Administrative Code.
