Contingent Civil Monetary Remedy : MCTC agrees <br /> 411 that in addition to the above—mentioned amount , it shall pay in <br /> 51 equally divided amounts to the Board for deposit in the State <br /> 6 Water Pollution Cleanup and Abatement Account and to the <br /> 7I Department the following additional civil monetary remedies as <br /> 81 <br /> provided herein. Each of the following civil monetary remedies <br /> 9 are contingent upon a determination of the existence of the <br /> IO i1 prerequisite factual situation associated with that civil <br /> 11 '' monetary remedy as specified below. The civil monetary <br /> 12 ' <br /> remedies apply only to soil and groundwater contamination <br /> 13 � levels attributable to .a release of the specified substance <br /> 14 . f.r-..om the facility. <br /> I1 ' <br /> 15 II MCTC shall pay the civil monetary remedies in an <br /> 16 amount assessed by the Department and the Board up to the <br /> 17 ' maximum specified for each factual situation. The Department <br /> 1811 and the Board can assess civil monetary remedies for any of the <br /> 191 following groundwater contamination conditions occurring in <br /> 2011 different aquifers and for the following soil contamination <br /> II <br /> 21 , conditions . The contingent civil monetary remedies assessed <br /> 22 !:, <br /> „ pursuant to subparagraph B. 2 (a) and/or B. 2 ( b) of this Article <br /> 23i VII only may be cumulative up to a maximum of $ 50, 000.
