Work Order issued under this section, shall be extended for the term of the Stop Work <br /> Order at a minimum. <br /> 11.0 Department Required Modifications. The Department reserves the right to <br /> require modification, replacement, or additions to remediation facilities if those facilities are <br /> not achieving remediation objectives or protecting public health, safety or the environment, <br /> including those identified in the Remedial Action Plan or Remedial Design. The <br /> Respondent reserves its right to object to, and all defenses it may have with respect to, any <br /> effort by the Department to require modification, replacement, or additions to the <br /> remediation facilities. The Department also reserves the right to require additional <br /> evaluations, designs and the construction and operation of facilities to achieve these <br /> objectives. The Respondent similarly reserves its defenses, contentions and objections <br /> with respect to any such requirements by the Department. <br /> 12.0 Compliance With Applicable Laws. Respondent shall carry out this <br /> Agreement in compliance with all applicable local, state, and federal requirements, <br /> including, but not limited to, requirements to obtain permits and to assure worker safety. <br /> 13.0 Respondent Liabilities. Nothing in this Agreement shall constitute or be <br /> construed as a satisfaction or release from liability for any conditions or claims arising as <br /> a result of past, current or future operations of Respondent. Nothing in this Agreement is <br /> intended or shall be construed to limit the rights of any of the parties with respect to claims <br /> arising out of or relating to the deposit or disposal at any other location of substances <br /> removed from the Site. <br /> 14.0 Site Access. Access to the Site shall be provided at all reasonable times to <br /> employees, contractors and consultants of the Department. Access to laboratories (if <br /> owned by Respondent consultants) used for analyses of samples under this Agreement <br /> shall also be provided as outlined above. Nothing in this paragraph is intended or shall be <br /> construed to limit in any way the right of entry or inspection that the Department or any <br /> other agency may otherwise have by operation of any law.
