activities pursuant to this Agreement, nor shall the State of California be held as a party <br /> to any contract entered into by Respondent or its agents in carrying out activities pursuant <br /> to this Agreement. <br /> 18.0 Additional Actions. Nothing in this Agreement is intended or shall be <br /> construed to limit or preclude the Department from taking or ordering any further actions <br /> authorized by law to protect public health or safety or the environment and recovering the <br /> cost thereof. Nothing in this Agreement shall be construed to limit in any way the defenses <br /> that Respondent may have to any such efforts by the Department. <br /> 19.0 Extension Requests. If Respondent is unable to perform any activity or <br /> submit any document within the time required under this Agreement, Respondent may, <br /> prior to expiration of the time, request an extension of the time in writing. The extension <br /> request shall include a justification for the delay. <br /> 20.0 Extension Approvals.ovals. If the Department determines that good cause exists <br /> for an extension, it will grant the request and specify a new schedule in writing. The <br /> Department may not unreasonably withhold approval of an extension request. Respondent <br /> shall comply with the new schedule, which is incorporated in this Agreement. <br /> 21.0 Financial Assurance. Respondent will demonstrate and maintain financial <br /> assurance as required by California Health and Safety Code Section 25355.2. <br /> Respondent shall demonstrate and maintain financial assurance mechanisms set forth in <br /> subdivisions (a) to (e), inclusive, of Section 66265.143 of Title 22 of the California Code <br /> of Regulations. As an alternative, Respondent may demonstrate and maintain financial <br /> assurance by means of a financial assurance mechanism other than those set forth above <br /> if the alternative financial assurance mechanism has been submitted to, and approved by, <br /> the Department as being at least equivalent to the financial assurance mechanisms <br /> specified above. The Department shall evaluate the equivalency of the proposed <br /> alternative financial assurance mechanism principally in terms of the certainty of the <br /> availability of funds for required operation and maintenance activities and the amount of <br />
