Hazelton Avenue <br /> Stockton, CA 95205 <br /> E-Mail: gbackus(&sijzov.org <br /> RE: Revised Corrective Action Statement Regarding Violation 3010 and the Former <br /> Marley Cooling Tower Company Inc.Facility,200 N Wagner Ave., Stockton, CA; <br /> CERS ID 10182275 <br /> Dear Mr. Backus: <br /> This letter, and the attachment, is a Corrective Action Statement to the San Joaquin County <br /> Environmental Health Department's (SJCEHD)Large Quantity Hazardous Waste Generator <br /> Compliance Review Report, dated March 3,2022,regarding the Former Marley Cooling <br /> Tower Company(MCTC)facility(the"Facility"), located at 200 N. Wagner Ave, Stockton, <br /> CA. As documented in our March 18, 2022 supplemental response and your March 28, 2022 <br /> email, SPX Cooling Technologies, Inc. (SPX)already submitted documentation correcting all <br /> of the alleged violations and only one remains pending: Violation 3010. This letter shall serve <br /> as a replacement supplemental response to the April 3,2022 Corrective Action Statement, <br /> amending that Corrective Action Statement as requested by your April 4,2022 email. <br /> As discussed in the prior communications, SPX agreed to accept the alternative interpretation <br /> that the yellow bin below the filter press is a hazardous waste container,with waste <br /> accumulating from the moment it contains filter cake. With this interpretation, SPX agrees to <br /> comply with SJCEHD's categorization of the Facility as a large quantity generator(LQG). <br /> From April 3,2022 onward,the Facility's hazardous waste will not be taken to a Small <br /> Business hazardous waste facility unless and until a change of circumstances occurs at the <br /> Facility, changing the generator status to a Conditionally Exempt Small Quantity Generator <br /> (CESQG). <br /> SPX would like to thank SJCEHD for their ongoing cooperation.
