Compliance Summary <br /> The Discharger was issued Administrative Civil Liability (ACL) Order R5-2014-0505 for the <br /> years of 2011 and 2013, assessing a total of$42,000 for 14 effluent violations. Of the 14 <br /> effluent violations cited in the ACL, 8 effluent violations were Group II Serious Violations of <br /> Orders R5-2003-0030 and R5-2008-0170 for total chromium, chromium III, and copper, while <br /> 6 effluent violations were non-serious violations of Order R5-2008-0170 for effluent limitations <br /> of total dissolved solids. The Discharger settled the ACL through payment in the amount of <br /> $42,000. <br /> The Discharger was issued ACL Order R5-2017-0529 for effluent violations that occurred <br /> during the period from 1 January 2014 through 30 June 2017, assessing a total of$27,000 for <br /> 9 violations. Of the 9 effluent violations cited in the ACL, 8 effluent violations were Group II <br /> Serious Violations of Order R5-2014-0013 for chromium and total copper, while 1 effluent <br /> violation was a non-serious violation of Order R5-2008-0170 for effluent limitations of total <br /> dissolved solids. <br /> E. Planned Changes — Not Applicable <br /> III. APPLICABLE PLANS, POLICIES, AND REGULATIONS <br /> The requirements contained in this Order are based on the requirements and authorities described <br /> in this section. <br /> A. Legal Authorities <br /> This Order serves as WDR's pursuant to article 4, chapter 4, division 7 of the California Water <br /> Code (commencing with section 13260). This Order is also issued pursuant to section 402 of <br /> the federal Clean Water Act (CWA) and implementing regulations adopted by the U.S. EPA <br /> and chapter 5.5, division 7 of the Water Code (commencing with section 13370). It shall serve <br /> as an NPDES permit for point source discharges from this Facility to surface waters. <br /> B. California Environmental Quality Act (CEQA) <br /> Under Water Code section 13389, this action to adopt an NPDES permit is exempt from the <br /> provisions of Chapter 3 of CEQA, (commencing with section 21100) of Division 13 of the <br /> Public Resources Code. <br /> C. State and Federal Laws, Regulations, Policies, and Plans <br /> 1. Water Quality Control Plans. Requirements of this Order specifically implement the <br /> applicable Water Quality Control Plans. <br /> a. Basin Plan. The Central Valley Water Board adopted a Water Quality Control Plan <br /> for the Sacramento River and San Joaquin River Basins, Fifth Edition, May 2018 <br /> (hereinafter Basin Plan) that designates beneficial uses, establishes water quality <br /> ATTACHMENT F— FACT SHEET F-7 <br />
