Per Pruven <br /> Parsad, Line Haul Manager,the driver was washing his truck with a hose connected to a spigot on the fuel island <br /> between dispenser#2 and#3.The following facility's procedure for containing spills on the Emergency Contingency <br /> Plan section D was not implemented: <br /> #12 Notify and evacuate persons in all threatened and/or impacted areas" <br /> #15 Remove containers and/or isolate areas <br /> REGULATION GUIDANCE: <br /> Title 22 California Code of Regulations section 66265.51 Purpose and Implementation of Contingency Plan <br /> Title 22 California Code of Regulations section 66265.52 Content of Contingency Plan <br /> Title 22 California Code of Regulations section 66265.56 Emergency Procedures <br /> CORRECTIVE ACTION: Immediately prepare a contingency plan, maintain on-site and train employees on the plan <br /> contents. Provide a corrective action statement and supporting documentation to the San Joaquin County <br /> Environmental Health Department(EHD)within 30 days. <br /> This is a Class II violation. <br /> 301 CCR 66265.31 Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: During the on-site emergency response inspection, the Linehaul Manager, Pruven Parsad, <br /> confirmed that the driver washed his truck in the fuel port and rinsed the spill (DEF)down the storm drain and <br /> oil-water separator. DEF was observed all over the dispenser.Absorbent was observed inside the storm drain west <br /> of the fuel island and inside oil-water separator between dispenser#2 and#3. This was confirmed by contractor of <br /> ANCON. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately clean the oil-water separator. Manage the waste according to Title 22 <br /> California Code of Regulations for hazardous waste. Submit a statement and supporting documentation to the San <br /> Joaquin County Environmental Health Department describing the storage and final disposition of the cleaned up <br /> waste. <br /> This is a repeat violation, Class II. <br /> Overall Inspection Comments: <br /> On-site for a Emergency Response inspection. Complete and submit a copy of the Return to Compliance <br /> Certification form to the EHD with a statement documenting the corrective actions that have been or will be <br /> taken for each violation, and any supporting paperwork, by 5/5/2022 . <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br /> ($152).
