SAN ,,] DAQ U I <br /> N Environmental Health Department <br /> C0uT IV <br /> Aboveground Petroleum Storage Act Inspection Report <br /> Facility Name: Facility Address: Date: <br /> TCI LEASING AND RENTAL 2150 W CHARTER WAY, STOCKTON February 16, 2022 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 718 CFR 112.8(c)(10) Failed to promptly correct visible discharges and/or remove accumulations of oil in diked areas. <br /> OBSERVATION: The facility failed to promptly correct visible discharges of oil from the spill container at the 15,000 <br /> gallon diesel tank(several inches of standing fuel were noted inside the spill container), several inches of oily liquid <br /> was also observed inside the secondary containment under the used oil containers. <br /> REGULATION GUIDANCE: (c)(10) Promptly correct visible discharges which result in a loss of oil from the <br /> container, including but not limited to seams, gaskets, piping, pumps, valves, rivets, and bolts.You must promptly <br /> remove any accumulations of oil in diked areas. <br /> CORRECTIVE ACTION: Immediately remove all fuel/oil accumulations and manage all wastes according to the <br /> California Code of Regulations Title 22 hazardous waste regulations, submit proof of correction to the EHD. <br /> This is a Class II violation. <br /> 719 CFR 112.8(c)(11) Failed to locate properly or provide sufficient secondary containment for mobile/portable <br /> containers. <br /> OBSERVATION: Facility failed to position portable storage containers to prevent a discharge as described in 40 <br /> CFR 112.1(b).The facility failed to furnish a secondary means of containment, such as a dike or catchment basin, <br /> sufficient to contain the capacity of the largest single compartment or container with sufficient freeboard to contain <br /> precipitation. One 55-gallon container of waste oil, located near the waste oil tank(next to waste oil storage area) <br /> was observed without secondary containment.Also, standing oily liquid was observed in secondary containment <br /> for the waste oil storage containers. <br /> REGULATION GUIDANCE: (c)(11) Position or locate mobile or portable oil storage containers to prevent a <br /> discharge as described in§ 112.1(b). Except for mobile refuelers and other non-transportation-related tank trucks, <br /> you must furnish a secondary means of containment, such as a dike or catchment basin, sufficient to contain the <br /> capacity of the largest single compartment or container with sufficient freeboard to contain precipitation. <br /> CORRECTIVE ACTION: Maintain all secondary containment to ensure that sufficient capacity is provided,furnish <br /> all necessary secondary containment to prevent discharge. Provide proof or correction to the EHD. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> This is an amended inspection report issued on 2/16/2022, violation 718 was added to the originally issued <br /> inspection report. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a <br /> statement documenting the corrective actions that have been or will be taken for each violation, and any <br /> supporting paperwork, by 3/16/2022 . <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br /> ($152).
