Apparently, during the rulemaking of the <br /> new regs, industry kept pushing for a list to be included of what constituted significant change. We (Board staff) <br /> didn't want a list, but industry kept pushing and the Board directed us to include a list. Therefore, in the new regs <br /> like Garrett pointed out, there is a reference that an increase in hours at facilities would be a permit revision. <br /> There is no discussion of how that would be figured. <br /> As the facility is"increasing" its hours for the public from 4pm to 5pm, and without any other guidance or <br /> directions in regulations or in the rulemaking package of how to calculate if there is an increase, we feel that we <br /> cannot deviate from the regulation. We understand of course that Evan Edgar might address the Board during <br /> the discussion of this item and try and have the Board direct us to establish guidance on this issue for future <br /> permits, but without that, we are unable to do anything, but go strictly by what is in the regulation. <br /> Actually,just for clarification, the only thing different in the process from a revised permit and a modified permit is <br /> that a modified permit doesn't have to go to our Board, and that our Executive Director can sign off. All the same <br /> application package requirements are there, so as far as the applicant goes, there is nothing "streamlined". <br /> Please let me know if that answers your question.
