Box 4025 <br /> Sacramento, CA 96812-4025 <br /> RE: Tracy Material Recovery Facility and Transfer Station <br /> Board of Equalization — Integrated Waste ManagementFee"Account <br /> Certification of Non-Disposal Activity <br /> Dear Mr. Vlach: <br /> Tracy Material Recovery Facility and Transfer Station (Tracy MRF/TS) Facility <br /> apparently has been recently added to a list at the California Integrated Waste <br /> Management Board (CIWMB) that places the facility into a "disposal facility" <br /> category whereby the Board of Equalization (BOE) is now seeking past payment <br /> of the Integrated Waste Management Account (IWMA) fees. The purpose of this <br /> Tetter is to inform the CIWMB that the Tracy MRF/TS does not landfill or dispose <br /> of waste on-site, and to request the*CIWMB to remove Tracy MRF/TS from the <br /> list as soon as possible, and to inform the BOE to rescind the "Notice of <br /> Delinquency" letters dating back to 2000 that were just issued on May 2, 2007. <br /> The Tracy MRF/TS has a Full Solid Waste Facility Permit (SWFP) No. 39-AA- <br /> 0024 issued by the San Joaquin County Environmental Health Department and <br /> concurred with by the CIWMB. The SWFP permitted operations.inctuge. ,, <br /> "Material Recovery Facility", a "Transfer Station", and a "Composting- aci #y":�rc� <br /> The SWFP explicitly does not allow "Landfill Disposal Site" and no waste has <br /> been buried or disposed on-site. Other permitted operations include "Cannery <br /> Waste Site". <br /> Tracy MRF/TS hereby certified that no waste has been buried or land applied on- <br /> site since 2000. The past "Cannery Waste Site" activity included transferring <br /> dried cannery wastes from the facility to cattle feed in the community. The <br /> permitted activity, LEA Conditions 17.o does include the specific operational <br /> standards allowing the operation to spread cannery waste to promote drying, <br /> upon which the dried waste would be disced into the soil. <br />
