CONDITIONS OF APPROVAL <br /> MS-00-23 <br /> Huber <br /> Minor Subdivision Application No. MS-00-23 was approved by the San Joaquin County Community <br /> Development Department on August 23, 2000. The effective date of approval is September 2, 2000. <br /> This tentative map approval will expire on September 2, 2003, which is three years from the effective <br /> date of approval,unless(1) all Conditions of Approval have been complied with and (2) a Parcel Map <br /> has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified,and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Chandler Martin,468-3144) <br /> a. TENTATIVE MAP: The parcel map shall substantially conform with the approved(revised)tentative <br /> map dated August 21, 2000. <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 50 feet. (Development Title Section 9-410.4) <br /> c. ACCESS: The following access requirements apply and shall be shown on the Parcel Map: <br /> (1) Proposed 30-foot-wide easements for access to Parcels 5, 6, 7, and 8 (as shown on the <br /> approved Tentative Map) shall be shown on the Parcel Map. (Development Title Section 9- <br /> 1150.15) <br /> (2) The following note shall be placed on the Parcel Map and also shall be recorded as a separate <br /> instrument: <br /> A. At the time of development of any parcel, the entire length of the private right-of-way for that <br /> parcel shall be constructed and maintained to the standards required by Section 10.207 of <br /> the Uniform Fire Code and applicable San Joaquin County Improvement Standards. <br /> (Development Title Section 9-1150.15[c)) <br /> d. TREE PRESERVATION: Future development on the parcels shall be consistent with the <br /> requirementsof the County's Tree Preservation Ordinance(Development Title Section 9-1505.2). <br /> 2. DEPARTMENTOF PUBLIC WORKS (Seethe attached memo dated August 16, 2000.) <br /> 3. PUBLIC HEALTH SERVICES (See the attached memo dated July 25, 2000.) <br /> 4. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision, which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br />
