Board staff agrees with ERS's assessment that natural bacteria in the area are contributing to biochemical degradation of <br />nitrogen in soil and groundwater. Confirmation samples show groundwater concentrations of nitrate at 82 milligrams <br />per liter (mg/L) in December 2019, above the Maximum Contaminant Level of 10 mg/L. However, due to continued <br />natural degradation of nitrogen, these levels of nitrate are projected to drop to 10 mg/L by 2023. This represents a drop <br />in nitrate concentrations to sufficient levels in an acceptable time frame. <br />Based on these data, BM Storage Corporation submitted a Site Closure Request in July 2020. Board staff reviewed the <br />request for regulatory closure and believe there is merit to this request. As such, we are conducting a public <br />participation comment period that allows interested parties to comment on the proposed case closure.
