Sludge waste of this type should also be tested for acute aquatic <br /> toxicity per Title 22 California Code of Regulations section 66261.24(a)(6) to determine if it's a non-RCRA hazardous <br /> waste. The hazardous waste determination on the sludge is incomplete. <br /> The facility also needs to update the California Environmental Reporting System https://cers.calepa.ca.gov/ and answer <br /> "yes"to the business activities questions "Does your facility generate Hazardous Waste" and "Does your facility treat <br /> hazardous waste". <br /> The site launders textiles soiled with used oil,therefore a hazardous waste treatment permit is required from my <br /> department per California Health &Safety Code section 25144.6. Please see the attached code section. Also see the <br /> attached invoice from Alpine Meats showing that oily terry cloth wipers were laundered at the Hunter Street <br /> facility. Our inspector verified during his inspection that the terry cloths were used to wipe up used oil. <br /> The hazardous waste treatment permit is required even if the sludge complete hazardous waste determination shows <br /> the sludge to be non-hazardous waste. <br /> Thank you, <br /> Garrett Backus, Ld.
