FINDINGS FOR USE PERMIT <br /> PA -2200025 <br /> RODNEY R . & GAYLA L . SCHATZ TRUST / OPERATIVE OFFICE <br /> 1 . The proposed use is consistent with the goals , policies , standards , and maps of the General Plan , any <br /> applicable Master Plan , Specific Plan , and Special Purpose Plan , and any other applicable plan <br /> adopted by the County . <br /> • This finding can be made because the Large Winery use type may be conditionally permitted <br /> in the AG40 ( General Agriculture , 40 acre minimum ) zone with an approved Use Permit <br /> application . The project site has a General Plan designation of A /G ( General Agriculture ) , <br /> and the AG -40 zone is an implementing zone for this designation . There are no Master Plans , <br /> Specific Plans , or Special Purpose Plans in the vicinity . <br /> 2 . Adequate utilities , roadway improvements , sanitation , water supply , drainage , and other necessary <br /> facilities have been provided , and the proposed improvements are properly related to existing and <br /> proposed roadways . <br /> • This finding can be made because adequate utilities , access roads , sanitation , drainage , <br /> and other necessary facilities have been provided or are proposed and the improvements <br /> are properly related to existing and proposed streets and highways . The project site is <br /> already served by on -site well , wastewater treatment system , and storm drainage <br /> constructed under permit and inspection by the Environmental Health Department and the <br /> Department of Public Works . A new additional septic system is proposed for the new tasting <br /> room and will be constructed under permit and inspection by the Environmental Health <br /> Department . <br /> 3 . The site is physically suitable for the type of development and for the intensity of development . <br /> • This finding can be made because the 38 . 12 -acre parcel is of adequate size and shape to <br /> accommodate the proposed and existing uses , and all yards , building coverage , setbacks , <br /> parking areas and other requirements of the Development Title . Parking requirements for the <br /> winery are 74 permanent parking spaces and 50 overflow parking spaces . All required spaces <br /> are depicted on the site plan . <br /> 4 . Issuance of the permit will not be significantly detrimental to the public health , safety , or welfare , or be <br /> injurious to the property or improvements of adjacent properties . <br /> • This finding can be made because the project has been conditioned to meet San Joaquin <br /> County development regulations that protect public health , safety , and welfare and ensure <br /> the project is not injurious to adjacent properties . Additionally , the Initial Study prepared for <br /> this project found no potentially significant environmental impacts that could not be <br /> mitigated to a less than significant impact . <br /> 5 . The use is compatible with adjoining land uses . <br /> • This finding can be made because the proposed use will not interfere with nor alter the current <br /> land uses on adjacent properties . Surrounding uses are agriculture with scattered <br /> residences . A winery is an agricultural use permitted in agricultural zones and therefore is <br /> compatible with adjoining land uses . <br /> PA- 2200025 — Findings 1 <br />
