The following is an itemized list of aboveground petroleum storage act violations that <br /> have not been addressed for CUNHA DRAYING INC as of May 27, 2022. <br /> Open violations from March 08, 2022 inspection <br /> Violation#604-Plan failed to include oil type and storage capacity for each container. <br /> OBSERVATION: The Spill Prevention, Control, and Countermeasure(SPCC)Plan failed to address the type of oil <br /> and storage capacity for portable and/or mobile containers. Page 9 of the SPCC plan states that, "Several 55-gallon <br /> oil product drums within the shop area and outside the shop." Two 55 gallon drums of oil were observed in the <br /> storage container outside the shop and four 55 gallon drums of oil were observed in the shop. <br /> REGULATION GUIDANCE: The SPCC plan shall include: (i)The type of oil in each fixed container and its storage <br /> capacity. For mobile or portable containers, either provide the type of oil and storage capacity for each container or <br /> provide an estimate of the potential number of mobile or portable containers,the types of oil, and anticipated <br /> storage capacities. <br /> CORRECTIVE ACTION: The SPCC Plan shall properly address the type and storage capacity of all fixed and <br /> portable and/or mobile containers, as required. Submit proof of correction to the EHD. <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#610-Plan failed to adequately detail information and procedures for reporting a discharge. <br /> OBSERVATION: The Spill Prevention, Control, and Countermeasure(SPCC) Plan does not adequately discuss <br /> procedures for reporting a discharge. Page 18& 19 of the SPCC plan incorrectly names the phone number for the <br /> Environmental Health Department as"San Joaquin County Public Health Services Department." <br /> REGULATION GUIDANCE: The SPCC plan shall include: (vi)Contact list and phone numbers for the facility <br /> response coordinator, National Response Center, cleanup contractors with whom you have an agreement for <br /> response, and all appropriate Federal, State, and local agencies who must be contacted in case of a discharge as <br /> described in § 112.1(b). <br /> (4)Unless you have submitted a response plan under§ 112.20, provide information and procedures in your Plan to <br /> enable a person reporting a discharge as described in § 112.1(b)to relate information on the exact address or <br /> location and phone number of the facility;the date and time of the discharge,the type of material discharged; <br /> estimates of the total quantity discharged; estimates of the quantity discharged as described in§ 112.1(b);the <br /> source of the discharge; a description of all affected media;the cause of the discharge; any damages or injuries <br /> caused by the discharge; actions being used to stop, remove, and mitigate the effects of the discharge;whether an <br /> evacuation may be needed; and, the names of individuals and/or organizations who have also been contacted. <br /> CORRECTIVE ACTION: Ensure the SPCC Plan includes accurate procedures for reporting a discharge.
