Per the California Medical <br />Waste Management Act HSC 118285 <br />(d) a sharps container only needs to be labeled with the words "sharps waste" or with the <br />international biohazard symbol and the word "BIOHAZARD". This sharps container also <br />contains pharmaceutical waste so the words "Incineration Only" must also be on the <br />container but is it not required to be on the lid and all lateral sides because it is <br />still considered a sharps container governed under 118285. <br />If the violation was written after making a reference to HSC 118280, the HSC 118280 does <br />not apply to this situation. The HSC 118280 labeling requirements are only for containers <br />other than sharps containers. <br />Attached is an email from Alison Dabney, Chief of the California Department of Public <br />Health, Medical Waste Management Program. The current regulations for any sharps <br />container is defined per 118285, and not 118280. Should further discussion about this <br />issue be requested I would be happy to assist and be present.
