OBSERVATION: The emergency response(ER) procedures were lacking or inadequate. The emergency <br />response procedures for 2020 were submitted late and lacking the local unified program Agency (CUPA) phone <br />number. <br />REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a <br />release or threatened release of hazardous materials, including, but not limited to, the following: <br /> - immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br /> - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment <br /> - evacuation plans and procedures, including immediate notice, for the site <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />2. OBSERVATION: The emergency response(ER) procedures were not submitted for 2021 and 2022. <br />REGULATION GUIDANCE: Per H&SC 25508.2, the business owner/operator shall annually review and certify that <br />the business plan is complete, accurate, up-to-date and in compliance with Section 11022 of Title 42 of the United <br />States Code. An annual electronic submittal satisfies these requirements. The annual business plan shall be <br />submitted/certified by January 15 of each calendar year and may be submitted beginning November 1 of the <br />previous year. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, review and submit/certify the <br />current information. <br />This is a repeat violation, Class II. <br /> 8 HSC 25505(a)(4) Failed to establish and electronically submit a reasonable or an adequate training program. <br />OBSERVATION: A training program was not submitted for 2021 and 2022. <br />REGULATION GUIDANCE: Per H&SC 25508.2, the business owner/operator shall annually review and certify that <br />the business plan is complete, accurate, up-to-date and in compliance with Section 11022 of Title 42 of the United <br />States Code.
