OBSERVATION: Facility does not meet the Ag exemption and failed to complete and submit training program(s). REGULATION GUIDANCE: To meet this exemption, a farming business shall: -annually submit the Hazardous Materials Inventory -mark each building that stores any pesticides, petroleum fuels and oil, or fertilizers with warning signs -provide training for all employees in safety procedures in the event of a release or threatened release of a hazardous material. Training programs for all employees and annual training, including refresher courses, shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or threatened release of a hazardous material.Training shall cover, but not limited to, all of the following: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate notice,for the business site. These training programs may take into consideration the position of each employee. CORRECTIVE ACTION(S): Immediately take all steps to meet the requirements for exemption from filing a training plan, or log into the CERS at http://cers.calepa.ca.gov/, and upload a training plan for all employees that address annual training, including refresher courses, safety procedures for the event of a release or threatened release of a hazardous material, including, but not limited to,familiarity with the facility's emergency response plans and procedures. These training programs may take into consideration the position of each employee. This is a Class II violation. Overall Inspection Comments: Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were nine violations observed during the inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by 03/09/2022. To minimize person to person contact EHD is choosing to write the name of person receiving the report instead of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate ($152). To schedule an appointment, please call (209)468-3420. Notes: Observed several open totes and containers. Ensure all the containers are closed to prevent spill and exposure. Business has been in operation longer than thirty days. According to Owens Hoady the chemical totes have been on site since November 2021 and plans on discontinuing the business, plants are being destroyed at this moment, and all chemicals will be removed from site. I explained to Owens Hoady that the chemicals need to be removed from the site as soon as possible and he should let EHD know to conduct a closure inspection after all the chemicals have been removed from the facility.
