No waterways impacted. Has been stopped and contained. Cleanup is being conducted by a contractor." <br />OBSERVATIONS: <br />Arrived on-site and met with Jeremiah Ramirez, Sr Process Engineer. Observed a spill of process water containing pond <br />solids from JR Simplot's fertilizer manufacturing process, east of the facility's waterponds and west of McKinley Ave. The <br />spill impacted the soil on the west shoulder of McKinley Ave and the soil west of the facility's fence. No storm drains or <br />waterways were impacted. Ancon Services was on-site covering the spill area on the shoulder with visqueen and cones; the <br />shoulder will be excavated after USA dig is approved. Per Jeremiah, Ancon will begin the clean up on the west side of the <br />fence today. Per Jeremiah, the excavated impacted soil will be placed back into the facility's fertilizer manufacturing process. <br />Jeremiah provided a safety data sheet for ammonium sulfate, indicating that the released pond water and solids contains <br />ammonium sulfate. <br />Please be advised that the disposal of any waste [HSC 5411] or disposal of any hazardous waste, or the causing thereof, is <br />prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 <br />(a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting <br />procedure [HSC 25160 (b)(3)]. <br />Please address all released material and provide a written hazardous waste determination and disposal documentation for <br />the generated waste. <br />5/17/21 UPDATE: Based on email communication dated 5/14/21, JR Simplot indicated that "the excavated impacted soils <br />will be containerized, characterized for disposal, and disposed of under manifest offsite." <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />ICORRECTIVE ACTIONS / ORDER: <br />EHD 25-01 Rev, 9/16/2020 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br />Page 1 of 2 <br />1868 E.
