Per Sergeant Butler, 40 gallons of diesel was released from the left saddle tank due to a vehicular accident. I <br />observed diesel staining on the road (asphalt) and shoulder (gravel and soil). I observed Anthony placing absorbent pads <br />beneath the left saddle tank as it continued to drip diesel. Dave's Towing and Derek of Patriot Environmental arrived shortly <br />after 8pm. The saddle tanks were emptied before the truck was towed away. The diesel was placed into 2 black metal 55 <br />gallon drums. Per Derek, approximately 40 gallons was drained from the left saddle tank and approximately 45 gallons from <br />the right saddle tank. The drums were labeled as hazardous waste, closed, secured with cones, and left on site. Per Derek, <br />the drums will be picked up tomorrow. Absorbent was applied to the impacted asphalt/road and swept onto the impacted <br />soil and gravel.Derek covered the impacted soil and gravel with poly sheeting and weighed it down with bags of absorbent <br />and the hazardous waste drums. Per Derek, they anticipate excavating sometime next week. <br />Please be advised that the disposal of any waste [HSC 5411] or disposal of any hazardous waste, or the causing thereof, is <br />prohibited when the disposal is at a facility that is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 <br />(a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting <br />procedure [HSC 25160 (b)(3)]. <br />Facilitate spill cleanup by properly trained individuals, provide hazardous waste determinations and waste/hazardous waste <br />disposal records for impacted material to the EHD <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />ORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />IMMEDIATELY <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
