Complaint Investigation Summary Report #: 5105 <br />COMPLAINT ID: C00053079 Site Location: 4863 E CARPENTER RD <br />Activity Summary <br />Activity Date Recorded by <br />12/03/2020 Continuation of complaint received during regular work hours. GAITAN <br />5:20pnn Met with Jim Chapin, Operation Manager for JR Simplot. Showed me the <br />impact area. Impact area on soil is approximately 50 feet long and one foot wide. <br />Tony Ruff, Manager, stated that he excavated approximately 4 inches of soil and <br />stopped excavation based on visualization. <br />Another soil impact area was observed west of the initial impact area <br />approximately 3 by 3 feet. <br />Jim stated that absorbent was used on concrete area and will be kept on site and <br />reused. <br />I observed the following: <br />-One 300-gallon tote with soil impacted with round up power max. <br />One 300-gallon tote half filled with soil impacted with round up power max. <br />One 300-gallon tote half filled with absorbent with round up power max. <br />Five 15 gallon containers with recovered round up power max. <br />Jim stated that soil impacted with round up and recovered round up will all be sold <br />as product to farmers. I asked if that was a normal practice, he stated yes. <br />Contacted Elena Manzo 'Lead Senior REHSI based on conversation I discussed <br />with Jim to take a soil sample. He stated that he has to contact John Pallen, EHS <br />Manager, to receive permission. Generated Notice to abate (NTA). Received a call <br />from John, he stated that Jim will be taking confirmation samples tomorrow. I <br />asked what time will confirmation sampling will be performed and that EHD will <br />have to be there to ensure sampling was taken correctly. He stated tomorrow <br />afternoon. Sent NTA to Jim Chapin, I asked if any evacuations or injuries <br />occurred, he stated that no evacuations or injuries occurred from the release. <br />Sent message to Elena updating her on complaint. <br />Contacted John, to discuss confirmation sampling. He stated that Jim Chapin may <br />take sampling at 7am when the shift begins. I asked if I could be notified an hour <br />beforehand so I can witness sampling. <br />Left site at 6:20pm. <br />12/04/2020 Discussed complaint with Jason Gaitain, REHS, Haza Saeed, Ld Sr REHS, and FLORIDO <br />Melissa Nissim, CUPA Program Coordinator. <br />12/04/2020 Met with Jim Chapin and witnessed him take confirmation soil samples. Spoke to FLORIDO <br />John Pallen, Environmental Contact. Emailed John and others spill and sample <br />area photos and informed him that Robert P. of Ag Commisioner's Office will not <br />approve the sale of the contaminated soil to a farmer. <br />Generated Prop 65 and Emergency Response Record Form. <br />12/04/2020 Generated photo log. Sent copy to Elianna Florido IREHSI. GAITAN <br />12/04/2020 Contacted Jim Chapin, Operations Manager for JR simplot. Asked if sampling was GAITAN <br />scheduled to take place today around noon. He stated he intends on taking <br />sampling in the morning.
