SANJOAQUIN <br />-cOUNTY- <br />Greatness arows here <br />Environmental Health Department <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: THE HOME DEPOT STORE #6660 Date: May 06, 2021 <br />RP Mailing Address: 213 COURT ST, SUITE 700 C/O COMPLIANCE DEPT Record ID#: C00053770 <br />MIDDLETOWN, CT 06457- Program Element: 2546 <br />Spill Location: 2960 REYNOLDS RANCH PKWY, LODI <br />Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />5 GALLONS OF FUEL, (UNKNOWN IF IT IS DIESEL OR REGULAR AT THIS TIME), SPILLED IN THE PARKING LOT. <br />OBSERVATIONS: <br />Arrived on-site and observed the spill area, approximately 12 ft x 20 ft in size or about the size of a parking lot space, <br />located in the Home Depot parking lot. No storm drains or soil were impacted. The spill area was blocked off from the <br />public. Met with Miranda Lazari, Home Depot Manager, who stated the spill was caused by an unknown individual trying to <br />siphon fuel from a vehicle, and when Home Depot employees began to clean up the spill, using absorbent powder, the <br />asphalt began to disintegrate and break apart. Miranda notified Verisk 3E of the issue. Accordinto to Verisk 3E, US Ecology <br />is en route to complete the clean-up. Home Depot generated a hazardous waste drum, approximately 55-gallons in size, of <br />used absorbent from the initial clean-up. The drum is located in Home Depot's hazardous waste storage area. <br />Please be advised that the disposal of any waste [HSC 5411] or disposal of any hazardous waste, or the causing thereof, is <br />prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 <br />(a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting <br />procedure [HSC 25160 (b)(3)]. Provide waste/hazardous waste disposal records to the EHD for all clean up debris <br />associated with this spill clean up. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />° Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />" Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />IMMEDIATELY <br />Submit copies of hazardous waste manifests/disposal records to the END. <br />WITHIN 30 DAYS <br />Other Correction <br />EHD 25-01 Rev. 9/16/2020 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE Page 1 of 2 <br />1868 E.
