NO WATERWAYS IMPACTED. <br />OBSERVATIONS: <br />On 11/2/2021, Mike Algots, Union Pacific Railroad Hazmat Manager, provided a waybill showing the leaked shipping <br />container contained various corrosives such as sodium hydroxide, acetic acid, ammonia solutions, nitric acid, sulfuric acid, <br />hydrochloric acid, and sodium hyudroxide solution, as well as flammable printing ink. Mike did not immediately know what <br />material leaked from the container. Derek Smith of Patriot Environmental Services was on site but needed to obtain more <br />equipment, including a PID meter, in order to begin the spill clean-up. Derek stated he would begin the clean up on the <br />morning of 11/3/2021. EHD to verify clean up on 11/3/2021.. <br />Please be advised that the disposal of any waste [HSC 54111 or disposal of any hazardous waste, or the causing thereof, is <br />prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC <br />25189.5(a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting <br />procedure [HSC 25160 (b)(3)]. <br />Immediately perform clean-up of the spill and notify the EHD when the clean-up is complete for verification. Provide all <br />hazardous waste determinations, sample analytical results, and waste/hazardous waste disposal records to the EHD for all <br />clean up debris associated with this clean up, within 30 days. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />c' Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />ORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />IMMEDIATELY <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />WITHIN 30 DAYS <br /> <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
