NO MATERIAL RECOVERED DUE TO RAPID DISSIPATION. RESPONSIBLE PARTY HANDLING <br />CONTAINMENT AND CLEAN UP. <br /> <br />OBSERVATIONS: <br />Arrived on-site and observed an electrical pole collapsed along the ditch north of Collier Rd. No transformer was observed. <br />Per Alex Steele of PG&E the collapsed transformer was removed from the site and a sample of oil from the transformer will <br />be analyzed for PCBs. The water inside the ditch was flowing west. A boom was observed on the water in the ditch. Oil was <br />not observed on or around the boom. Oil gobules were observed on the water next to vegetation in the ditch, just west of the <br />electrical pole. The spill clean-up is incomplete.. <br />Please be advised that the disposal of any waste [HSC 54111 or disposal of any hazardous waste, or the causing thereof, is <br />prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC <br />25189.5(a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting <br />procedure [HSC 25160 (b)(3)]. <br />Immediately perform clean-up of the spill and notify the EHD when the clean-up is complete for verification. Provide all <br />hazardous waste determinations, sample analytical results, and waste/hazardous waste disposal records to the EHD for all <br />clean up debris associated with this clean up, within 30 days. If the PCB analytical results show that the transformer oil <br />contains PCB, further clean-up and confirmation sampling is required per 40 CFR 761.125. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />o Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />IMMEDIATELY <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />WITHIN 30 DAYS <br />EHD 25-01 Rev. 9/16/2020 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATI Page 1 of 2 <br />1868 E.
