Environmental Health Department SAN4JOAQUIN <br />—COUNTY -- <br />Greotoess grows here. <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: BNSF RAILWAY CO Date: Aug 22, 2021 <br />RP Mailing Address: 740 E CARNEGIE DR Record ID#: COBEUM9DI <br /> <br />SAN BERNARDINO, CA 92408- Program Element: 2546 <br /> <br />Spill Location: 6540 S AUSTIN RD, STOCKTON <br /> Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />40 Gallons of diesel released from refrigeration unit JBRU568797. <br />OBSERVATIONS: <br />20 gallons of diesel was released when a tank was punctured due to derailment of refrigeration unit JBRU568797. Diesel <br />impacted hard packed dirt. No storm drains or waterways impacted. Spill stayed on facility property. Patriot Environmental <br />conducted initial clean-up of area on 8/21/2021 but did not complete clean-up. Clean-up will be completed on 8/23/2021. <br />BNSF to notify SJC EHD when clean-up is completed for verification prior to any backfilling of soil or ballast. Disposal <br />records for waste generated will be verified on next routine hazardous waste inspection. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />1: Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />'1 Other Correction <br />COST RECOVERY: All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br />rate.
