The following is an itemized list of hazardous waste violations that have not been <br />addressed for United # 5446 as of August 01, 2022. <br />Open violations from March 29, 2022 inspection <br />Violation #110 - Failed to keep signed copy of manifests from the designated facility for three years. <br />OBSERVATION Designated facility signed and dated copies of Uniform Hazardous Waste Manifests (UHWM) <br />were not found on-site. The missing manifest is: <br />-021765660JJK (4/14/2021) <br />REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br />with section 66262.23(a) for three years or until the generator receives a signed copy from the designated facility <br />which received the waste. This signed copy shall be retained as a record for at least three years from the date the <br />waste was accepted by the initial transporter. The hazardous waste generator must submit a copy of the manifest <br />to the California Department of Toxic Substances Control (DTSC) within 60 days if the destination facility signed <br />manifest copy is not received from the transporter or designated facility. <br />CORRECTIVE ACTION: Locate the destination facility signed manifests listed above and maintain in the facility file <br />for three years from the date of shipping. Send a copy to the San Joaquin County Environmental Health <br />Department (EHD). <br />❑ This violation was corrected ❑ This violation will be corrected by (date): <br />❑ Supporting documents included <br />Describe actions taken or will be taken to correct violation: <br />Violation #111- Failed to comply with uniform hazardous waste manifest exception requirements. <br />OBSERVATION The facility did not have exception reports on site for following Uniform Hazardous Waste <br />Manifest (UHWM): <br />-021765660JJK (4/14/2021) <br />REGULATION GUIDANCE: (a) A generator who does not receive a copy of the manifest with the handwritten <br />signature of the owner or operator of the designated facility within 35 days of the date the waste was accepted by <br />the initial transporter shall contact the transporter and/or the owner or operator of the designated facility to <br />determine the status of the hazardous waste. <br />(c) A hazardous waste generator who does not receive a copy of the manifest with the handwritten signature of the <br />owner or operator of the facility to which the generator's waste is submitted, within 60 days from the date that the <br />hazardous waste was accepted by the initial transporter, shall submit to the department a legible copy of the <br />manifest, with some indication that the generator has not received confirmation of delivery. <br />(d) Generators shall submit the information to the department at: DTSC Report Repository, Generator Information <br />Services Section, P.O. Box 806, Sacramento, CA 95812-0806 <br />CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San <br />Joaquin County Environmental Health Department (EHD). If the destination facility signed manifests cannot be <br />found then send to DTSC a copy of each generator signed manifest and a statement that the designated facility <br />signed copy was not received by the generator.
