GAVIN NEWSOM <br />GOVERNOR <br />OflA <br />Water Boards <br />JARED BLU MENFELD <br />SECRETARY FOR <br />ENVIRONMENTAL PROTECTION <br />Central Valley Regional Water Quality Control Board <br />03 August 2021 <br />Lauren Mancuso <br />Manager, Environmental Site Remediation <br />Union Pacific Railroad Company <br />1408 Middle Harbor Road <br />Oakland, CA 94606-1803 <br />NO FURTHER ACTION DETERMINATION, UNION PACIFIC RAILROAD PORT OF <br />STOCKTON DIESEL RELEASE, 2201 WEST WASHINGTON STREET, STOCKTON, <br />SAN JOAQUIN COUNTY <br />In July of 2020, a Union Pacific Railroad Company (UPRR) train engine spilled an <br />unknown amount of diesel fuel onto ballast and soil at an isolated portion of Central <br />California Traction Company Track PN002-9-906, located in a staging area within the <br />Port of Stockton, San Joaquin County (Site). UPRR assumed responsibility for the <br />release and immediately initiated cleanup activities, which included free product <br />recovery and excavation. Post-excavation soil sample confirmation results were all <br />below residential Environmental Screening Levels. The attached memo provides <br />additional details. The Central Valley Water Quality Control Board (Central Valley Water <br />Board) staff concurs with UPRR that the spill area does not pose a threat to human <br />health, the environment, or waters of the State. <br />On 20 June 2021, UPRR distributed a Public Notice to neighboring property owners and <br />interested persons notifying them that the Central Valley Water Board was considering <br />No Further Action for the Site and of their opportunity to provide comments. The 30-day <br />public comment period ended on 20 July 2021 and no comments were received. <br />UPRR has satisfactorily completed site investigation, implemented timely remedial <br />actions, and achieved applicable remedial action standards and objectives. Sample <br />analysis demonstrated compliance with the most conservative ESLs and therefore a <br />permanent remedy has been accomplished at the Site. This No Further Action <br />Determination is effective as the date of this executed letter. <br />Issuance of a No Further Action Determination does not preclude future action by the <br />Central Valley Water Board if subsequent monitoring, testing, or analysis of the UPRR <br />Site indicates that the remedial action standards and objectives were not achieved; a <br />KARL E.
