SAN,1,0,AQUIN <br /> Environmental Health Department <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: PACIFIC GAS & ELECTRIC COMPANY <br />Date: Jul 06, 2020 <br />RP Mailing Address: PO BOX 7640 Record ID#: COUGKWFWJ <br />SAN FRANCISCO, CA 94120- Program Element: 2546 <br />Spill Location: 5839 E ARMSTRONG, LODI Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />Approximately 20 gallons non-PCB oil released onto soil. <br />OBSERVATIONS: <br />On July 5, 2020, approximately 20 gallons of non-PCB oil spilled onto soil due to an automobile accident. Dark oily soil <br />covered an area of about 11 by 6 feet. Dave Larsen (PG&E) coned-off the oil spill area and initiated a USA dig notification. <br />Please be aware that all impacted soil has to be excavated and disposed of under the appropriate waste manifesting <br />procedure [HSC 25160 (b)(3)]. The disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal <br />is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Notify EHD (48-hours) in <br />advance of any cleanup activities. Provide disposal records for all generated wastes. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />° Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />° Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Other Correction <br />COST RECOVERY: All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br />rate.
