SA1‘,1461,p AQUIN <br />,Asior „age/ Greatness nrorec horr <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Environmental Health Department <br /> <br />Responsible Party: YARA NORTH AMERICA INC Date: Jan 12, 2021 <br />RP Mailing Address: 3019 NAVY DR <br />Record ID#: COVEGSHNN <br />STOCKTON, CA 95206- Program Element: 2546 <br /> <br />Spill Location: 3031 NAVY DR, STOCKTON <br />Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />APPROXIMATELY 262 GALLONS OF CN-9 FERTILIZER SPILLED ONTO PAVEMENT, STORM DRAIN, AND ON-SITE <br />RETENTION POND. <br />OBSERVATIONS: <br />A Yara North America Inc truck was overfilled and resulted in a 262-gallon spill of C-N9 fertilizer onto the pavement, storm <br />drain, and on-site retention pond. The pavement was cleaned by facility personnel using water prior to my arrival. Observed <br />the pavement was adequately cleaned. Cleanup of the storm drain, line, and retention pond is pending. Clean up all <br />released material and dispose of it under all appropriate waste manifesting and waste disposal laws and regulations. The <br />disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is at a facility which is not permitted <br />or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Please be aware that all hazardous waste shall be disposed <br />of under appropriate hazardous waste manifesting procedure [HSC 25160 (b)(3)]. Make a hazardous waste determination <br />for all waste materials and dispose of them as required, and provide proof of correction and copies of waste disposal <br />records to the EHD. <br />VIOLATIONS: <br />a Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />a Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />la Other Correction <br />EHD 25-01 Rev. 9/16/2020 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br />Page 1 of 2 <br />1868 E.
