Observed a strong <br />gasoline like odor was observed in the area of the sunken boat. Hard booms, soft booms, and absorbent pads are applied <br />around the back end of the boat. Coast Guard and Fish and Wildlife have been notified. According to Alex Thompson, boat <br />owner, 2-3 gallons of gasoline are kept in the fuel tank at all times. <br />Please be advised that the disposal of any waste [HSC 5411] or disposal of any hazardous waste, or the causing therefor, is <br />prohibited when the disposal is at a facility that is not permitted or authorized for hazardous waste disposal. [HSC <br />25189.5(a)] Please ensure that all necessary spill notifications to other agencies are made. Provide a written statement <br />documenting the corrective action measures that were put in place to minimize the potential for future release.Immediately <br />clean the oil with absorbent pads and booms from the water and properly dispose of hazardous waste. Immediately lift the <br />boat out of the water. Provide SJC EHD with copies of the final disposal records for all generated hazardous waste. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />L' Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />r' Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />IMMEDIATELY <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Other Correction <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
