The complaint alleged that there is an accumulation of garbage <br /> onsite resulting in odors and a rodent infestation. The results of the investigation confirmed that this property is <br /> subject to the accumulation of solid waste. There was a large amount of junk material along the Auto Ave and <br /> near the center of the property. The dumpster was over flowing and additional waste piled around the dumpster. <br /> This is a violation of State law/regulation and County ordinance codes: <br /> 1. San Joaquin County Ordinance(SJCO),No. 2887,Title 5, Division 2, Chapter 4, <br /> • Section 5-2400; Accumulation of refuse,waste, and filth prohibited. <br /> • Section 5-2402; Metallic or Plastic Containers Required. <br /> 2. Title 14 California Code of Regulation, Section 17410.1; Solid waste Removal <br /> According to the PRC, Section 45000,45005, and 45011,this department has the authority to issue an <br /> administrative order requiring the owner of a property to take corrective action as necessary to abate a nuisance, <br /> cease any illegal action, and establish a time schedule that the site shall be brought into compliance. <br /> Effective immediately cease and desist all unauthorized accumulation of solid waste at the above referenced <br /> property. Solid waste must not be accumulated for more than seven(7)days. All waste onsite, including <br /> recyclables, must be stored in a closed container. Recyclables can be accumulated for longer periods, if <br /> maintained in a container with tight fitting lid. The waste material must be removed from the property and <br /> disposed of at a permitted disposal facility. Evidence of proper disposal must be provided to EHD. . All <br /> violations must be corrected by January 27,2021.
